Acceptible Use Policy


The Acceptable Use Policy for our Internet services reflects the policies of our upstream Internet providers.

Please check back from time to time to make sure you are aware of any updates.

1.    BY USE OF EPC ONLINE SERVICES THE USER ACCEPTS THESE TERMS
       AND CONDITIONS. EXECUTIVE PERSONAL COMPUTERS, INC. ("EPC"), ITS
       PRINCIPALS AND ASSOCIATES, HEREINAFTER REFERRED TO AS EPC ONLINE,
       DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT
       LIMITED TO, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
       PARTICULAR PURPOSE. This Acceptable Use Policy may be revised from time to time
       and your use of EPC's Service(s) after changes to the AUP are posted on the applicable
       EPC web site shall constitute your acceptance of any changed or additional terms of the
       Acceptible Use Policy.

2.    EPC ONLINE will not be responsible for any damage, including direct,
       indirect, consequential or incidental, that a user or third party may suffer.
       This includes, but is not limited to loss of data resulting from delays, non-
       delivery, miss-delivery, SPAM & virus filtering or service interruptions as
       a result of EPC ONLINE or user actions. User explicitly assumes all risks
       and indemnifies and holds harmless EPC ONLINE against any damages that
       may arise due to viruses, worms, Trojan horses, logic bombs, trap doors,
       and other computer diseases and security violations that are obtained or
       exercised through EPC ONLINE services.

3.    User explicitly acknowledges that EPC ONLINE exercises no control over the
       content or nature of any information passing through EPC ONLINE. User also
       assumes the entire risk as to the accuracy and nature of information obtained or
       received through EPC ONLINE services.

4.    User agrees to indemnify and hold harmless EPC ONLINE for any damages
       that may occur to user or other party as a result of user use of EPC ONLINE
       services.

5.    Use of any information obtained from or through EPC ONLINE services is entirely
       at user's own risk. EPC ONLINE makes no warranties and accepts no responsibility
       for the accuracy or quality of such information. User further assumes all risk of
       damage from any use of such information, even if EPC ONLINE has been informed
       of any dangers that may result from such use. User acknowledges that EPC ONLINE
       does not have sufficient knowledge of user equipment configuration, nor sufficient
       resources to screen and forward information regarding any dangers that may arise due
       to EPC ONLINE services.

6.    User agrees to pay any damages which may be claimed against EPC ONLINE
       or its management for any losses incurred by EPC ONLINE or its management
       because of user storing, retrieving or causing to store, by or on EPC ONLINE
       equipment, copyrighted or pornographic materials or information.

7.    User agrees not to send unsolicited advertisements or messages to other
       users of EPC ONLINE services or users of the network known as the Internet.

8.    Distribution of bulk unsolicited e-mail through EPC ONLINE systems or
       networks is prohibited. Use of a return address (forged or legitimate) in
       the "epconline.com" Internet domain, or any other domain hosted by EPC
       ONLINE, in any unsolicited bulk e-mailing is also prohibited.

9.    User agrees not to establish web servers, ftp servers, IRC BOTS or
       utilize programs that maintain a constant connection on a NON-DEDICATED
       dial-up account.

10.  Individual dialup accounts are for the use of one individual (or family
       unit living at the same residence) only. ONLY ONE CONCURRENT DIALUP SESSION
       IS PERMITTED. Use of two or more simultaneous dialup sessions under the same
       account is not possible with our service. Attempts may result in disruption
       of service, additional charges or termination of service as appropriate.

11.  EPC ONLINE will provide 30 days written notice of an increase in base
       prices. The user will then have 10 days from the date of the effective
       increase to provide EPC ONLINE with a written request to terminate service
       and incur no termination liability. Otherwise, the user's existing service
       will be billed at the new base prices.

12.  EPC ONLINE offers automatic credit card charging of monthly services.
       Account access may be revoked if credit card processing fails due to
       insufficient or refused credit, unreported replacement cards, or unreported
       expiration extensions. Authorization to charge user credit card is valid
       until user account is canceled by verifiable notification.

13.  EPC ONLINE invoices are submitted in advance. User agrees to pay
       invoices upon receipt of invoice, and until user account is canceled by
       verifiable notification. Users agree that contracted subscription fees are
       NON-REFUNDABLE. User's account is subject to immediate suspension and a
       $25.00 service charge for checks returned for any reason.

14.  ALL USE OF EPC ONLINE SERVICES MUST BE FOR LAWFUL PURPOSES. USE OF EPC
       ONLINE SERVICES IN VIOLATION OF ANY APPLICABLE FEDERAL, STATE, OR LOCAL LAW
       OR REGULATION IS PROHIBITED AND WILL RESULT IN TERMINATION OF SERVICE, AND
       IMMEDIATE NOTIFICATION OF PROPER AUTHORITIES.


       Any activity on EPC's network(s) that is a violation of any local, state,
       or federal law or regulation is a violation of this AUP. Prohibited
       activities include, but are not limited to:


       transmitting any defamatory, libelous, fraudulent, deceptive indecent,
           offensive, or obscene materials;
       using the Service(s) to deliver spyware, or secretly or deceptively obtain
           the personal information of third partiesbr />
           (phishing, etc.);
       intentionally spreading computer viruses;
       gaining unauthorized access to private networks;
       engaging in the transmission of pirated software;
       conducting or participating in illegal gambling, soliciting for illegal
           pyramid schemes through electronic mail or
           USENET postings.
       violating rules, regulations, and policies applicable to any network, server,
           computer database, web site, or ISP that
           you access through the Service(s);
       threatening, harassing, abusing, or intimidating others; or
       creating or attempting to utilize a domain name that is defamatory,
           fraudulent, indecent, offensive, deceptive,
           threatening, abusive, harassing, or which damages the name or reputation of EPC.

15.  You are prohibited from engaging in any other activity, illegal or not,
       that EPC determines in its sole discretion, to be harmful to its
       subscribers, operations, network(s), reputation, goodwill, or customer
       relations.

       Responsibility for Content


       EPC takes no responsibility for any material created or accessible on or
       through the EPC network(s) and Service(s). EPC shall not be obligated to
       monitor or exercise any editorial control over such material, but reserves
       the right to do so. In the event that EPC becomes aware that any such
       material may violate this AUP and/or expose EPC to civil or criminal
       liability, EPC reserves the right to block access to such material and
       suspend or terminate any user creating, storing or disseminating such
       material. EPC further reserves the right to conduct investigations into
       fraud, violations of the Terms of Service, this AUP, or other laws or
       regulations, and to cooperate with legal authorities and third parties in
       the investigation of alleged wrongdoing, including disclosing the identity
       of the user that EPC deems responsible for the wrongdoing.

17.  EPC performs routine surveillance of its network(s) in connection with
       its web hosting, data center hosting, and related services. Although EPC
       will not, as an ordinary practice, proactively monitor your activities for
       violations of this AUP, there may be instances in which EPC, through its
       routine surveillance finds violations of this AUP, and reserves the right to
       take whatever action it deems appropriate in its sole discretion.

EPC Online has a new billing system.

To keep up with the new credit card processor procedure, we have upgraded to a new billing system to maintain our ability to process credit cards.

This new system is still being polished with our content, but it's functional and much more secure than our previous system.
